We sell all goods and services under the following conditions:
§1 General - Scope
Our terms and conditions apply exclusively, deviating conditions of the customer are not valid. The terms and conditions are the basis for all offers, contracts, deliveries and services that are made between TrimixExplorer and its customers.
§2 Offer – Offer Documents
The products available in the online shop of TrimixExplorer.de do not constitute an offer in the legal sense. Contracts only come into being through the order and our written order confirmation or, if no such confirmation is available, through our delivery.
§3 Prices - terms of payment - shipping costs
Unless otherwise agreed, our prices are due for payment either in advance, PayPal or cash on delivery, plus the shipping and packaging costs incurred. The seller reserves the right to exclude individual payment. The current legal VAT is included in our prices. The amount of the delivery and shipping costs depend on the respective products and are shown in the offer. The amount of the shipping costs can be found in our shipping price list, which can be viewed online. For services, €15.00 per processing case is generally due.
§4 Delivery time
The start of the delivery time specified by us presupposes that all technical questions have been clarified. The delivery takes place at the earliest after the customer has received the money and the products are available. The seller is entitled to provide partial services to the buyer to an extent that is reasonable for the buyer. Additional shipping costs only arise if expressly agreed. The seller endeavors to dispatch the goods as quickly as possible. Concrete delivery times cannot be guaranteed, however, since it does not depend solely on the seller how quickly the goods are received by the recipient. As a rule, all items are delivered to the buyer within 3 - 10 days after receipt of money, with the exception of bulky goods such as compressed air bottles.
§5 Right of Withdrawal
The buyer who is a consumer has the following statutory right of withdrawal:

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached model cancellation form, which you can download here, but it is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired. For diving courses and diving trips, the payment and course conditions apply, which can be viewed on the website.
Consequences of revocation
If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.
If you have requested that the services should begin during the cancellation period, you must pay us a reasonable amount that corresponds to the proportion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract Comparison.
§6 Warranty and Guarantee
The warranty period is 2 years and begins when the goods are handed over. During this time, all defects that are subject to the statutory warranty will be remedied free of charge. The buyer's warranty claims are initially limited to supplementary performance. If the subsequent performance fails, the buyer has the right to withdraw from the purchase or reduce the purchase price, at his own discretion. The buyer proves the date of the start of the warranty/guarantee by means of the proof of purchase (invoice). Excluded from the warranty or guarantee are damages that can be traced back to natural wear and tear, improper use and insufficient or incorrect care. Claims that go beyond the value of the goods due to damage that could arise with or through goods delivered by us are expressly excluded. In the event of a warranty or guarantee, the buyer must contact our contact address.
§7 Joint Liability
Any further liability for damages than that provided for in Section 6 is excluded - regardless of the legal nature of the asserted claim. This applies in particular to claims for damages arising from culpa in contrahendo, other breaches of duty or other claims for compensation for damage to property in accordance with § 823 BGB. Insofar as the liability for damages towards us is excluded or limited, this also applies with regard to the personal liability for damages of our employees, employees, employees, representatives and vicarious agents.
§8 Retention of title security

All data arising within the framework of the contractual relationship are stored and processed by us, TrimixExplorer, taking into account the Federal Data Protection Act.
§10 event organization and diving training
The following conditions apply to participation in events, diving courses and diving excursions or events which are organised, carried out and managed by TrimixExplorer:
1. The participant undertakes to move within the framework of his training at diving events and to adhere to these guidelines.
2. Upon request, he can present his qualifications for the planned activity. This qualification must be carried at every event. If the qualification is not sufficient, the diving instructor or his assistant or an employee of TrimixExplorer on site has the right to rewrite the booked event or to exclude individual people from it.
3. In the case of diving courses, the instructions of the conducting diving instructor or assistant must be observed.
4. TrimixExplorer acts as organizer of events and diving excursions. However, certified divers dive under their own responsibility as part of their training. In the event of misconduct by the customer, TrimixExplorer cannot be blamed and recourse can be taken.
5. In the case of third-party services that are only mediated as part of the event, any liability is governed by the conditions of the mediated company, which we can provide on request. We are only liable for the proper mediation of this service.
6. We expressly point out that the diver must have diving accident insurance, which covers hyperbaric chamber treatment (also abroad) and which covers the costs incurred. Without the same, participation is not possible, or only at an increased risk, which must be borne by the diver himself. The company TrimixExplorer and their employees cannot be held responsible for this.
§11 Additional
The law of the Federal Republic of Germany applies, the validity of the UN sales law is excluded. The place of jurisdiction for all legal disputes arising from this contract is the place of business of TrimixExplorer.
